UK: FBI beschlagnahmt Server

Am Abend des 7. Oktober hat das FBI in London die indymedia Webpräsenz für 20 Staaten vom Netz genommen und die Festplatten beschlagnahmt. Eine in den USA rechtsgültige Vorladung konnte durch Rechtshilfeabkommen und/oder britschen Überwachunsgesetzen auch gleich dem Hosting Provider einen Maulkorb gegen eine Nennung der Gründe erteilen.

Feds seize Indymedia servers

Rackspace UK complied with a legal order and handed over hard disks without first notifying Indymedia. It's unclear if the raid was executed under extra-territorial provisions of US legislation or the UK's Regulation of Investigatory Powers Act (RIPA). Provisions of RIPA make it a criminal offence to discuss warrants, so Rackspace would not be able to discuss the action with its customer Indymedia, or with the media.

On Thursday, 7 October around 18 GMT two Indymedia servers hosted by Rackspace in the UK went down.

The servers (ahimsa) host the sites of more then 20 local collectives, radio streams for several radio stations, BLAG (a Linux distribution as well as miscellanous other projects.

The next day, 8 October Rackspace stated that they responded to a "Commissioner's subpoena". "Rackspace is acting as a good corporate citizen and is cooperating with international law enforcement authorities. The court prohibits Rackspace from commenting further on this matter."

Indymedia failed to get information from authorities in the US and the UK.

According to an AFP report, published on 8 October, "the FBI acknowledged that a subpoena had been issued but said it was at the request of Italian and Swiss authorities. 'It is not an FBI operation,' FBI spokesman Joe Parris told AFP." Indymedia could not get direct confirmation of this statements.

The list of affected local media collectives includes Ambazonia, Uruguay, Andorra, Poland, Western Massachusetts, Nice, Nantes, Lilles, Marseille (all France), Euskal Herria (Basque Country), Liege, East and West Vlaanderen, Antwerpen (all Belgium), Belgrade, Portugal, Prague, Galiza, Italy, Brazil, UK, part of the Germany site, and the global Indymedia Radio site.
